As a responsible processor of personal data under the Digital Personal Data Protection Act, 2023 (hereinafter referred to as the "DPDP Act"), Si Creva Capital Services Private Limited (CIN: U65923MH2015PTC266425) (“Company”), having its registered office at Office Units 2, 3 and 4, 10th Floor, Tower 4, Equinox Park, LBS Marg, Kurla West, Mumbai, Maharashtra 400070 hereby issues this notice to the Borrower and Co-Borrower(“You”/ “Your”) to inform You about the processing of your personal data in accordance with the provisions of the DPDP Act. We value Your trust and are committed to protecting Your privacy and personal data. This Data Privacy Notice explains in simple terms what data we collect, why we collect it, how we use it, who we share it with, and how You can exercise your rights under law.

• Personal Data We Collect

  We may collect the following categories of personal data from You:

  • Basic Details: Name, date of birth, gender, contact details (phone number, email, residential address).
  • Identity & KYC Data: Aadhaar, PAN, Voter ID, photographs, biometric data (if required under law).
  • Financial Information: Bank account details, income details, credit score, credit history, payment history.
  • Transactional Data: Loan details, repayments, purchase history when loans are used for transactions.
  • Device & Technical Data: IP address, location data, device identifiers, browser type, app usage data.

• Purpose of Processing Personal Data:

  We process Your personal data (ourselves or through our service partners) for the following purposes:

  • Assessing Your creditworthiness and eligibility for loan products offered by the Company.
  • Facilitating the disbursement and repayment of loans.
  • Managing and servicing Your loan account, including but not limited to collections, regulatory compliance, monitoring, and any other purposes necessary for the specified loan agreement.
  • We collect and process only such personal data as is adequate, relevant, and limited to what is necessary for the purposes stated above. We implement reasonable technical and organizational measures, including encryption, firewalls, access controls, and regular audits, to protect your data against unauthorized access, alteration, disclosure, or destruction.

• Legal Basis for Processing

  Your personal data is processed:

  • On the basis of your consent.
  • Where necessary for the performance of a contract (loan agreements, transactions);
  • To comply with legal obligations under the Reserve Bank of India Act, 1934, Prevention of Money Laundering Act, 2002, DPDP Act, and other applicable laws.

• Disclosure of Personal Data

  We do not sell your personal data to any third party. We may share Your personal data only with:

  • Regulators and statutory authorities (RBI, FIU, Income Tax, law enforcement agencies, etc.) where legally required.
  • Credit bureaus (CIBIL, Experian, Equifax, CRIF High Mark) for reporting loan performance.
  • Service providers and partners (payment gateways, IT vendors, collection agencies, customer support partners) under strict confidentiality obligations.
  • Group companies or affiliates, only for lawful business purposes.

• Right to Withdraw Consent:

  • You have the right to withdraw your consent for the processing of your personal data at any time. Upon receiving such a withdrawal, we will cease all processing activities and permanently delete your personal data, unless continued retention is required under applicable legal or regulatory obligations. In such case, the data will be retained solely for the duration necessary to satisfy those obligations

  • Upon withdrawal, we may not be able to provide certain services, but we will respect Your choice and stop processing Your data unless retention is required under law.

  • Right to Correction and Erasure: Correct inaccurate data or request deletion of data (subject to legal requirements).
  • Right to Nominate: Nominate another person to exercise Your rights in case of incapacity or death.

  This Data Privacy Notice may be updated from time to time. Any material changes will be communicated through our website/app or directly to You. Continued use of our services after such changes shall constitute Your deemed consent.
